Speeding Tickets
Millions of people in the Uk have been caught speeding. Here's what happens if you get a speeding ticket:
The registered keeper will receive a notification from the police to give details of the driver. The registered keeper receives it within 14 days of the speeding offence and has to return it within 28 days
If you don't complete ands return the form within the time limit you will receive 6 points on your driving licence
If the vehicle's speed is not too much above the speed limit, the driver will normally be offered a fixed penalty notice of three penalty points and a £60 fine. You may be offered a speed awareness course instead. If the level of speeding is more serious su7ch as 50mph in a 30mph zone you will not receive an offer of a fixed penalty fine but instead you will receive a summons to attend a court hearing. If you receive a fixed penalty notice but wish to defend the case then it will be heard in the magistrates court. many people feel that it is not worth the trouble of going to court and so pay the fine anyway.
Speed Cameras to avoid Speeding Tickets
There are several different types of speed cameras - the common ones are Gatso which uses a film and flash and Truvelo which uses an infra red beam. and spex cameras which work out your average speed over a set distance.
Defences
If you definitely were not speeding, you are entitled to ask the police to see their evidence that you were speeding. If you are caught on speed cameras you are entitled to see the pictures. It could be that the number plate has been misread or the camera is incorrectly calibrated.
If the owner fo the speeding vehicle does not know who was driving at the time this could also be a speeding ticket defence.
It is however no defence to a speeding ticket to say that there were no signs warning of speed cameras.
If the registered keeper does not receive the Notice of intended prosecution within the required 14 days or if there are major material mistakes on the form then this may prove to be a valid defence. Minor mistakes however are not taken into account.
